I once thought that Fawkes came along with the sword , which means there's a way for it to fly from Dumbledore's office to other places through the sorting hat . But the hat didn't seem to be at the Minister of Magic in OOTP , that's when I started to think the series's weird for the first time .

Fawkes can go as he please and maybe when Dumbledore weant to the Ministry he told Fawkes to go to or he brought Fawkes. We don't really learn about Fawkes because Sirius died and Harry and everyone else really didn't care about Fawkes.

I think some parts were left intentionally ambiguous and more to the reader's imagination, which is as it should be. You try to define everything and you'll end up with a dictionary, not an intriguing book that you can't wait to get your hands on.

True, we can’t expect JKR to fill in every detail. But she gave us enough for this.

(Have I said this somewhere before?) Other creatures have magic that wizards do not. She doesn’t explain how Hedwig can find Sirius, when he is public enemy #1 and the entire Ministry is looking for him. She doesn’t explain how Dobby can disperate inside Hogwarts when humans can not. It works for me an I don’t see it as inconsistant.

In OoP, Fawkes came out of nowhere and saved Dumbledore. That’s what Fawkes does. He had done it before. It makes sense to me.

She does explain why houseelves can disaperate and aperate in Hogwarts, because there magic is thought to be below thatof wizards. And for Hedwig if Sirius told her where he was for like the next months then she would know where he was.

She found Harry, too, in PoA. Tom of the Leaky Cauldron was impressed -- "Smart Owl you've got there..." No one told her that Harry was there. She just somehow knew.

It's what Hedwig does. It's what Dobby does. It's what Fawkes does, and we don't really need an explanation.

Malfoy got the wand when he disarmed Dumbledore before he died.

Yes Malfoy did disarm Dumbledore which means that Malfor was the owner but he did not pick it up and claim it. It was left behide and buried with Dumbledore. It did not work great magic for Voldamort because he did not win it he took it. When Harry took it he claimed it, so it worked for him.

it seems that for someone to become the master of the elder wand he has to beat(not kill)the previous owner of the wand,and the fact that Malfoy had never even touched the wand is unimportant because it is the owner you must beat.

About why Harry survived,he had a piece of Voldy's soul in him.For the Horcrux to be destroyed if it is completely unrelated to the host,the host can remain intact...
