I lay no claim to this. I completely stole this from another HP site I happened to run across and amjust copying an pasting. I thought it was interesting. I don't think Fudge is a death eater, but the rest is definitely intriguing. Part of the reason it caught my attention is that I too have always been troubled by Sirius laughing during his arrest. I've just been re-reading Prisoner of Azkaban, Chapter 10, The Marauders Map. It contains the conversation in the Three Broomsticks between Madam Rosemerta, Fudge and a few Hogwarts teachers, where Harry first learns of the supposed role of Sirius Black in the Potters' deaths.
It has never struck me before how close to the action Fudge was during Sirius' arrest. Fudge was Junior Minister in the Department of Magical Catastrophes (I love that title - a future job for Neville perhaps?) at the time of the showdown between Pettigrew and Black. By his own admission, he was "one of the first on the scene". The account of Black "standing there laughing" comes solely from Fudge.
I've always thought it was strange that Sirius Black, who remained sane in Azkaban entirely through belief in his own innocence, would have offered no defence when he was arrested for Pettigrew's murder. Reading Fudge's words in the Three Broomsticks has made me wonder:
What if Sirius didn't stand there laughing, but protested his innocence? Fudge could have given false evidence of Sirius behaving like a madman to ensure Black's conviction.
Or worse, what if Black recognised Fudge as a Death Eater, and his laughter simply reflects desperation because he knows that he is about to be tried and convicted by a corrupt Ministry?[/b]
